In January, if all goes according to schedule, U.S. District Court Judge John R. Tunheim (D. Minn.) will have finished the MDL Levaquin trial over which he has presided in recent weeks and he will be presiding over another lengthy trial: Insignia Systems v. News America Marketing, a false advertising/antitrust trial, pending before the Court since 2004.
November 29 was “D-Day” for pretrial filings with 48 docket entries of motions in limine, exhibit lists, etc., etc. The two sides’ proposed verdict forms are here and here. They’re quite similar, though defendants have made the jury’s obligation to make a finding as to “the relevant market” to analyze the antitrust claim an express finding on the verdict form.
